BUYING A HOME: | ||
1. Making the Decision to Buy: | ||
The decision to purchase a home is often driven by the need for more space, the need to move to a new location or simply the desire to change one's life style. If you are unfamiliar with the area to which you are moving, the REALTOR you choose must make an effort to introduce you to the characteristics of the community and help you decide if this is a good match for your needs. Within any community there are variations by neighborhood, and these should become clear to you as you are shown properties in the community. By giving your REALTOR feedback, you can make the search process more efficient. If your REALTOR learns that you do not want to buy in a particular neighborhood, he or she will not show you properties there and will concentrate instead on those areas which interest you. | ||
2. Selection of a REALTOR: | ||
The selection of a REALTOR in a community such as Greenwich is made easier by the presence of the Greenwich Multiple Listing Service. Almost every real estate agent in the community is a member of the Greenwich MLS, which gives each REALTOR access to every property listed by every office in the membership. Therefore, it is not necessary to seek the services of more than one REALTOR. In your selection of a REALTOR, you should look for someone with whom you are compatible. When you initially meet with a REALTOR, whether this is someone to whom you have been referred or someone you have randomly chosen, you will be asked to sign a buyer authorization form. Required by state law in order for the REALTOR to show you properties, provide you with information, and negotiate on your behalf, this agreement will state the time frame during which the agreement is in effect, the kind of property it covers, and the area of Connecticut in which it is effective. If you are uncomfortable making a commitment to a REALTOR, ask that the time frame be limited to a day, a week, a month or any time frame which you feel you need to determine whether you would like to work with this person. When you ascertain that the relationship is compatible, you can sign an extension of the time frame. Since every REALTOR has access to the same properties through the Greenwich Multiple Listing Service, there is no need to use the services of more than one REALTOR concurrently. In fact, doing so can cause confusion to you and your REALTOR. Be sure that you have specifically described what you are looking for in a property and ask your REALTOR to introduce you to properties which most closely meet your criteria. Give feedback on properties that you are shown, so that your REALTOR can continue to refine the picture of what you need. If your criteria changes, communicate this to your REALTOR. For example, if you decide that a particular style of house does not fit your needs, let your REALTOR know so that houses of that style are no longer shown to you. It is a REALTOR's responsibility to inform you of any material facts about a property which he or she knows. These facts would be things such a condition of roof, presence of wetlands on a property, a known change to a road which will impact the property, etc. It does not include information about the seller's reason for selling, who the neighbors are, etc. Your REALTOR may not know everything about the property's condition; that is why you will have a building inspection done before signing the contract to purchase. When you have developed interest in a particular property, your REALTOR will be able to provide information about comparable sales in the area to help you determine value. Your REALTOR can arrange for you to visit the local schools, obtain information about programs available in the area and help you select the appropriate property. | ||
3. Mortgage Pre-Approval: | ||
You will contact a mortgage company or banking institution to understand what purchase price might be correct for you. Further understanding of your financial situation will allow the lender to issue you a "Pre-Approval" letter which stipulates that you have been approved for a mortgage up to a specific dollar value. This is a valuable asset for you during the negotiation process. If you are not familiar with the names of lenders in Greenwich, your REALTOR will be able to provide you with that information. | ||
4. Finding the Right Property: | ||
The search for your new home is truly a joint effort between you and your REALTOR. Be as open with your REALTOR as possible about your likes and dislikes. It is very important to tell your REALTOR what you like about each house you visit so he/she will begin to understand what you are looking for in the home you wish to buy. Between your input and your REALTOR's professional skills, the search will narrow until you ultimately find the "right" property for you. | ||
5. Making an Offer to Purchase: | ||
Once you have focused on one or two properties, your REALTOR will be able to provide you with market data on recently sold properties. This information will help both you and your REALTOR formulate your offer. Working with your REALTOR, you will be able to determine where you would initially like to start with your offer price. You should then develop a set of strategies, each dependent upon how the seller responds to your offer, so you do not end up "reacting" to any counter offer made by the seller. The offer may include, but is not limited to the following:

6. Finalizing your Financing: | ||
After an offer has been accepted by the seller the lending institution you have chosen will require an appraisal on the property to be mortgaged. The institution will send one or sometimes two appraisers to do a thorough inspection of the property to determine whether the property will qualify for the desired mortgage. Once the institution agrees to finance a particular property, they will issue a commitment letter whereby they agree to provide a certain dollar mortgage at a specific rate for a specific time and the buyer is assured the financing is in place. | ||
7. Utilities and other details: | ||
Your REALTOR will remind you about two weeks prior to closing that the appropriate utilities and services need to be notified in order to transfer the accounts to your name. These include, electric, gas, oil, propane, telephone and refuse. They may also include pool services, yard maintenance and more. During the same period the seller will be contacting the same providers to discontinue the same services. This transition needs to go smoothly to protect you from having to pay a "connection or hook up fee" because the service was completely terminated. Your REALTOR can help you with this, but the companies now require the new homeowner to initiate requests for service. | ||
8. The Contract: | ||
The seller will instruct their attorney to draw the Contract of Sale to include the terms agreed upon. Your agent will ensure that, at the same time, your attorney receives the necessary information so that he/she can begin their work and be prepared to receive and review the contract. Your attorney will review the contract from your perspective and insure that your interests are protected (such as including stipulations for delays, searching of Title, type of Title to be conveyed, cleanliness of the premises at the time of closing, etc.) The timing of this, dependent upon the complexity of the terms, should all take between five to ten days from accepted offer to signed contracts. You will normally be expected to submit an escrow check in the amount of 10% of the total purchase price (made out to the seller's attorney) with the signed contract. | ||
9. Closing Day: | ||
On the day of your closing, you and your REALTOR need to perform one last walk through of the premises. Together you will look to insure the property is in the condition is was when you signed the Contract of Sale. You will verify that the items to be included are present. You want to make sure the house and grounds are as specified within the contract and most important that there are no defects visible now which were previously hidden. You (or in your absence, you power-of-attorney) will attend the closing - primarily to sign appropriate documents and deliver checks for appropriate amounts. If your situation dictates, you may actually meet with your lender immediately prior to the time of the closing to sign your mortgage papers. Between your REALTOR, your attorney and your lender you will be advised ahead of time of all the costs and fees associated with your closing. | ||

3. Documents and Marketing Program: | ||
Once you select a REALTOR you will be requested to sign a listing contract, a Greenwich MLS data input form, a State of Connecticut "Residential Property Condition Disclosure Form", and a U.S. Environmental Protection Agency Disclosure Form regarding lead based paint hazards (for properties built prior to 1978). Your Agent will review these documents with you, and if you care to seek legal advice, then do so before signing. Selling your house is disruptive and can be intrusive into your every day life, but your agent will work hard to minimize this. | ||
4. Broker Open House: | ||
The listing REALTOR of your property will schedule an Open House for the other REALTORS who are members of the Greenwich MLS so they may preview it. This helps REALTORS determine which of their customers might be interested in viewing your house. The Open House schedule in Greenwich is specific to certain times and sections of town allowing REALTORS to see as many Open Houses as possible in the given time frame. The REALTOR will acquaint you with the various means by which a property can be shown. First, there is the installation of a keybox. Somewhat more restrictive is the method by which the listing REALTOR alerts MLS members that a key to the property will be held at the listing office and a confirmed appointment would need to be made through the office. The most restrictive method of showing is to require the listing REALTOR be present at the showing. This requires more scheduling between the homeowner, the listing REALTOR and the REALTOR who wishes to show the property to a client. | ||
6. Considering an Offer: | ||

7. The Contract Process: | ||
The seller is responsible for having the attorney draw the Contract for Sale which will include the agreed terms and conditions. The buyer will normally be expected to submit an escrow check (made out to your attorney) with the signed contract, usually in the amount of ten percent of the total purchase price. The contract is typically a Greenwich Bar Association contract which will contain every detail and a schedule of inclusions and exclusions as agreed upon by both parties. The Seller Disclosure Form is also delivered as part of this package. After the buyers have signed the contract, it is returned to your attorney with the escrow check. Your attorney will then go over the contract with you and you will sign it. | ||
8. Before Closing Day: | ||
Near to the date of your closing the buyer's REALTOR and the buyer need to perform one last walk-through of the premises. This is a reliable site to get your free credit report mandated by law. However, unless you are sure your computer is virus free, it is wise to call their toll free number, (877) 322-8228. You can use this site to get reports from all three major credit reporting agencies, Experian, Equifax or TransUnion. Ask that only the last four digits of your social security number be used when the report is sent to you. Kiplinger recommends AnnualCreditReport.com for credit reports.

FICO scores are used by most banks to decide on mortgage rates. This site will tell you how to get your score and how to improve it and provide a monitoring service. Once you know your FICO score you can use their site to see what your mortgage rate should be and compare it to the ones you have received. You can estimate your FICO score free at bankrate.com
FICO says the USA median score is 723 and the top score is 850. Apparently any score over 750 will get you the best rate.

Check to see if your Contractor is Registered in Connecticut
Home Improvement Contractors must be registered in Connecticut with the Department of Consumer protection. If your contractor is not registered they will not be able to get a building permit. It is always advisable to get a building permit, not only will the town inspection give you some assurance that the job was done correctly, but the Certificate of Occupancy (CO) will be necessary when you try to sell your home.

203(b): FHA program which provides mortgage insurance to protect lenders from default; used to finance the purchase of new or existing one- to four family housing; characterized by low down payment, flexible qualifying guidelines, limited fees, and a limit on maximum loan amount.
203(k): this FHA mortgage insurance program enables homebuyers to finance both the purchase of a house and the cost of its rehabilitation through a single mortgage loan.
Amenity: a feature of the home or property that serves as a benefit to the buyer but that is not necessary to its use; may be natural (like location, Woods, water) or man-made (like a swimming pool or garden).
Amortization: repayment of a mortgage loan through monthly installments of principal and interest; the monthly payment amount is based on a schedule that will allow you to own your home at the end of a specific time period (for example, 15 or 30 years)
Annual Percentage Rate (APR): calculated by using a standard formula, the APR shows the cost of a loan; expressed as a yearly interest rate, it includes the interest, points, mortgage insurance, and other fees associated with the loan.
Application: the first step in the official loan approval process; this form is used to record important information about the potential borrower necessary to the underwriting process.
Appraisal: a document that gives an estimate of a property's fair market value; an appraisal is generally required by a lender before loan approval to ensure that the mortgage loan amount is not more than the value of the property.
Appraiser: a qualified individual who uses his or her experience and knowledge to prepare the appraisal estimate.
ARM: Adjustable Rate Mortgage; a mortgage loan subject to changes in interest rates; when rates change, ARM monthly payments increase or decrease at intervals determined by the lender; the Change in monthly -payment amount, however, is usually subject to a Cap.
Assessor: a government official who is responsible for determining the value of a property for the purpose of taxation.
Assumable mortgage: a mortgage that can be transferred from a seller to a buyer; once the loan is assumed by the buyer the seller is no longer responsible for repaying it; there may be a fee and/or a credit package involved in the transfer of an assumable mortgage.
Balloon Mortgage: a mortgage that typically offers low rates for an initial period of time (usually 5, 7, or 10) years; after that time period elapses, the balance is due or is refinanced by the borrower.
Bankruptcy: a federal law Whereby a person's assets are turned over to a trustee and used to pay off outstanding debts; this usually occurs when someone owes more than they have the ability to repay.
Borrower: a person who has been approved to receive a loan and is then obligated to repay it and any additional fees according to the loan terms.
Building code: based on agreed upon safety standards within a specific area, a building code is a regulation that determines the design, construction, and materials used in building.
Budget: a detailed record of all income earned and spent during a specific period of time.
Cap: a limit, such as that placed on an adjustable rate mortgage, on how much a monthly payment or interest rate can increase or decrease.
Cash reserves: a cash amount sometimes required to be held in reserve in addition to the down payment and closing costs; the amount is determined by the lender.
Certificate of title: a document provided by a qualified source (such as a title company) that shows the property legally belongs to the current owner; before the title is transferred at closing, it should be clear and free of all liens or other claims.
Closing: also known as settlement, this is the time at which the property is formally sold and transferred from the seller to the buyer; it is at this time that the borrower takes on the loan obligation, pays all closing costs, and receives title from the seller.
Closing costs: customary costs above and beyond the sale price of the property that must be paid to cover the transfer of ownership at closing; these costs generally vary by geographic location and are typically detailed to the borrower after submission of a loan application.
Commission: an amount, usually a percentage of the property sales price, that is collected by a real estate professional as a fee for negotiating the transaction..
Condominium: a form of ownership in which individuals purchase and own a unit of housing in a multi-unit complex; the owner also shares financial responsibility for common areas.
Conventional loan: a private sector loan, one that is not guaranteed or insured by the U.S. government.
Cooperative (Co-op): residents purchase stock in a cooperative corporation that owns a structure; each stockholder is then entitled to live in a specific unit of the structure and is responsible for paying a portion of the loan.
Credit history: history of an individual's debt payment; lenders use this information to gouge a potential borrower's ability to repay a loan.
Credit report: a record that lists all past and present debts and the timeliness of their repayment; it documents an individual's credit history.
Credit bureau score: a number representing the possibility a borrower may default; it is based upon credit history and is used to determine ability to qualify for a mortgage loan.
Debt-to-income ratio: a comparison of gross income to housing and non-housing expenses; With the FHA, the-monthly mortgage payment should be no more than 29% of monthly gross income (before taxes) and the mortgage payment combined with non-housing debts should not exceed 41% of income.
Deed: the document that transfers ownership of a property.
Deed-in-lieu: to avoid foreclosure ("in lieu" of foreclosure), a deed is given to the lender to fulfill the obligation to repay the debt; this process doesn't allow the borrower to remain in the house but helps avoid the costs, time, and effort associated with foreclosure.
Default: the inability to pay monthly mortgage payments in a timely manner or to otherwise meet the mortgage terms.
Delinquency: failure of a borrower to make timely mortgage payments under a loan agreement.
Discount point: normally paid at closing and generally calculated to be equivalent to 1% of the total loan amount, discount points are paid to reduce the interest rate on a loan.
Down payment: the portion of a home's purchase price that is paid in cash and is not part of the mortgage loan.
Earnest money: money put down by a potential buyer to show that he or she is serious about purchasing the home; it becomes part of the down payment if the offer is accepted, is returned if the offer is rejected, or is forfeited if the buyer pulls out of the deal.
EEM: Energy Efficient Mortgage; an FHA program that helps homebuyers save money on utility bills by enabling them to finance the cost of adding energy efficiency features to a new or existing home as part of the home purchase
Equity: an owner's financial interest in a property; calculated by subtracting the amount still owed on the mortgage loon(s)from the fair market value of the property.
Escrow account: a separate account into which the lender puts a portion of each monthly mortgage payment; an escrow account provides the funds needed for such expenses as property taxes, homeowners insurance, mortgage insurance, etc.
Fair Housing Act: a law that prohibits discrimination in all facets of the homebuying process on the basis of race, color, national origin, religion, sex, familial status, or disability.
Fair market value: the hypothetical price that a willing buyer and seller will agree upon when they are acting freely, carefully, and with complete knowledge of the situation.
Fannie Mae: Federal National Mortgage Association (FNMA); a federally-chartered enterprise owned by private stockholders that purchases residential mortgages and converts them into securities for sale to investors; by purchasing mortgages, Fannie Mae supplies funds that lenders may loan to potential homebuyers.
FHA: Federal Housing Administration; established in 1934 to advance homeownership opportunities for all Americans; assists homebuyers by providing mortgage insurance to lenders to cover most losses that may occur when a borrower defaults; this encourages lenders to make loans to borrowers who might not qualify for conventional mortgages.
Fixed-rate mortgage: a mortgage with payments that remain the same throughout the life of the loan because the interest rate and other terms are fixed and do not change.
Flood insurance: insurance that protects homeowners against losses from a flood; if a home is located in a flood plain, the lender will require flood insurance before approving a loan.
Foreclosure: a legal process in which mortgaged property is sold to pay the loan of the defaulting borrower.
Freddie Mac: Federal Home Loan Mortgage Corporation (FHLM); a federally-chartered corporation that purchases residential mortgages, securitizes them, and sells them to investors; this provides lenders With funds for new homebuyers.
Ginnie Mae: Government National Mortgage Association (GNMA); a government-owned corporation overseen by the U.S. Department of Housing and Urban Development, Ginnie Mae pools FHA-insured and VA-guaranteed loans to back securities for private investment; as With Fannie Mae and Freddie Mac, the investment income provides funding that may then be lent to eligible borrowers by lenders.
Good faith estimate: an estimate of all closing fees including pre-paid and escrow items as well as lender charges; must be given to the borrower within three days after submission of a loan application.
HELP: Homebuyer Education Learning Program; an educational program from the FHA that counsels people about the homebuying process; HELP covers topics like budgeting, finding a home, getting a loan, and home maintenance; in most cases, completion of the program may entitle the homebuyer to a reduced initial FHA mortgage insurance premium-from 2.25% to 1.75% of the home purchase price.
Home inspection: an examination of the structure and mechanical systems to determine a home's safety; makes the potential homebuyer aware of any repairs that may be needed.
Home warranty: offers protection for mechanical systems and attached appliances against unexpected repairs not covered by homeowner's insurance; ,overage extends over a specific time period and does not cover the home's structure.
Homeowner's insurance: an insurance policy that .combines protection against damage to a dwelling and Is contents with protection against claims of negligence )r inappropriate action that result in someone's injury or )property damage.
Housing counseling agency- provides counseling and assistance to individuals on a variety of issues, including loan default, fair housing, and homebuying.
HUD: the U.S. Department of Housing and Urban Development; established in 1965, HUD works to create a decent home and suitable living environment for all Americans; it does this by addressing housing needs, improving and developing American communities, and enforcing fair housing laws.
HUD1 Statement: also known as the "settlement sheet," it itemizes all closing costs; must be given to the borrower at or before closing.
HVAC: Heating, Ventilation and Air Conditioning; a home's heating and cooling system.
Index. a measurement used by lenders to determine changes to the Interest rate charged on an adjustable rate mortgage.
Inflation: the number of dollars in circulation exceeds the amount of goods and services available for purchase; inflation results in a decrease in the dollar's value.
Interest: a fee charged for the use of money .
Interest rate: the amount of interest charged on a monthly loan payment; usually expressed as a percentage.
Insurance: protection against a specific loss over a period of time that is secured by the payment of a regularly scheduled premium.
Judgment: a legal decision; when requiring debt repayment, a judgment may include a property lien that secures the creditor's claim by providing a collateral source.
Lease purchase: assists low- to moderate-income homebuyers in purchasing a home by allowing them to lease a home with an option to buy; the rent payment is made up of the monthly rental payment plus an additional amount that is credited to an account for use as a down payment.
Lien: a legal claim against property that must be satisfied When the property is sold
Loan: money borrowed that is usually repaid with interest.
Loan fraud: purposely giving incorrect information on a loan application in order to better qualify for a loan; may result in civil liability or criminal penalties.
Loan-to-value (LTV) ratio.- a percentage calculated by dividing the amount borrowed by the price or appraised value of the home to be purchased; the higher the LTV, the less cash a borrower is required to pay as down payment.
Lock-in: since interest rates can change frequently, many lenders offer an interest rate lock-in that guarantees a specific interest rate if the loan is closed within a specific time.
Loss mitigation: a process to avoid foreclosure; the lender tries to help a borrower who has been unable to make loan payments and is in danger of defaulting on his or her loan
Margin: an amount the lender adds to an index to determine the interest rate on an adjustable rate mortgage.
Mortgage: a lien on the property that secures the Promise to repay a loan.
Mortgage banker: a company that originates loans and resells them to secondary mortgage lenders like :Fannie Mae or Freddie Mac.
Mortgage broker: a firm that originates and processes loans for a number of lenders.
Mortgage insurance: a policy that protects lenders against some or most of the losses that can occur when a borrower defaults on a mortgage loan; mortgage insurance is required primarily for borrowers with a down payment of less than 20% of the home's purchase price.
Mortgage insurance premium (MIP): a monthly payment -usually part of the mortgage payment - paid by a borrower for mortgage insurance.
Mortgage Modification: a loss mitigation option that allows a borrower to refinance and/or extend the term of the mortgage loan and thus reduce the monthly payments.
Offer: indication by a potential buyer of a willingness to purchase a home at a specific price; generally put forth in writing.
Origination: the process of preparing, submitting, and evaluating a loan application; generally includes a credit check, verification of employment, and a property appraisal.
Origination fee: the charge for originating a loan; is usually calculated in the form of points and paid at closing.
Partial Claim: a loss mitigation option offered by the FHA that allows a borrower, with help from a lender, to get an interest-free loan from HUD to bring their mortgage payments up to date.
PITI: Principal, Interest, Taxes, and Insurance - the four elements of a monthly mortgage payment; payments of principal and interest go directly towards repaying the loan while the portion that covers taxes and insurance (homeowner's and mortgage, if applicable) goes into an escrow account to cover the fees when they are due.
PMI: Private Mortgage Insurance; privately-owned companies that offer standard and special affordable mortgage insurance programs for qualified borrowers with down payments of less than 20% of a purchase price.
Pre-approve: lender commits to lend to a potential borrower; commitment remains as long as the borrower still meets the qualification requirements at the time of purchase.
Pre-foreclosure sale: allows a defaulting borrower to sell the mortgaged property to satisfy the loan and avoid foreclosure.
Pre-qualify: a lender informally determines the maximum amount an individual is eligible to borrow.
Premium: an amount paid on a regular schedule by a policyholder that maintains insurance coverage.
Prepayment: payment of the mortgage loan before the scheduled due date; may be Subject to a prepayment penalty.
Principal: the amount borrowed from a lender; doesn't include interest or additional fees.
Radon: a radioactive gas found in some homes that, if occurring in strong enough concentrations, can cause health problems.
Real estate agent: an individual who is licensed to negotiate and arrange real estate sales; works for a real estate broker.
REALTOR: a real estate agent or broker who is a member of the NATIONAL ASSOCIATION OF REALTORS, and its local and state associations.
Refinancing: paying off one loan by obtaining another; refinancing is generally done to secure better loan terms (like a lower interest rate).
Rehabilitation mortgage: a mortgage that covers the costs of rehabilitating (repairing or Improving) a property; some rehabilitation mortgages - like the FHA's 203(k) - allow a borrower to roll the costs of rehabilitation and home purchase into one mortgage loan.
RESPA: Real Estate Settlement Procedures Act; a law protecting consumers from abuses during the residential real estate purchase and loan process by requiring lenders to disclose all settlement costs, practices, and relationships
Settlement: another name for closing .
Special Forbearance: a loss mitigation option where the lender arranges a revised repayment plan for the borrower that may include a temporary reduction or suspension of monthly loan payments.
Subordinate: to place in a rank of lesser importance or to make one claim secondary to another.
Survey: a property diagram that indicates legal boundaries, easements, encroachments, rights of way, improvement locations, etc.
Sweat equity: using labor to build or improve a property as part of the down payment
Title 1: an FHA-insured loan that allows a borrower to make non-luxury improvements (like renovations or repairs) to their home; Title I loans less than $7,500 don't require a property lien.
Title insurance: insurance that protects the lender against any claims that arise from arguments about ownership of the property; also available for homebuyers.
Title search: a check of public records to be sure that the seller is the recognized owner of the real estate and that there are no unsettled liens or other claims against the property.
Truth-in-Lending: a federal law obligating a lender to give fuII written disclosure of aII fees, terms, and conditions associated with the loan initial period and then adjusts to another rate that lasts for the term of the loan.
Underwriting: the process of analyzing a loan application to determine the amount of risk involved in making the loan; it includes a review of the potential borrower's credit history and a judgment of the property value.
VA: Department of Veterans Affairs: a federal agency which guarantees loans made to veterans; similar to mortgage insurance, a loan guarantee protects lenders against loss that may result from a borrower default A. Our Buyer Agents are always compensated by the Seller. Commissions on properties listed on the MLS (Multiple Listing Service) are paid by the Selling Agency. For properties listed directly by owners, we ask the owner to pay our commission.
Q. Can I get a better deal by calling the firm advertising a listing?
A. Many people see an advertisement in the paper and call the listing company. This may seem like the best way to see a property, but it is precisely the wrong thing to do. The Realtor you are calling is the agent of the Seller. Their goal is to sell this property at the best price they can get for the Seller. Because many of the large real estate chains give their Realtors an extra commission if they sell the company’s listings, the Realtor you contact may have a special interest in selling you the house. In any event, they do not represent you or your interests.
Q. What training is required to be a Buyer’s Agent?
A. No training other than a real estate license. In Connecticut, because the state is a buyer-broker state, most Realtors get buyer representation training as part of their continuing education. In addition, they obviously get buyer representation experience every time they work with a buyer. REBAC (Real Estate Buyers Agent Council), a wholly owned subsidiary of the National Association of Realtors, also trains Realtors to be Buyer Agents and awards the ABR (Accredited Buyer’s Representative) designation to those who meet their educational and experience requirements.
Q. Do Buyer Agents collect compensation from both parties?
A. No. An agent for the Buyer cannot accept compensation from any other party to a transaction without the full knowledge and approval of the buyer.
Q. Don’t Buyer Agents make less money if they negotiate a lower price?
A. Realtors depend on “repeat business”. They do not get repeat business if the Buyer does not feel the Realtor did a good job. The difference in commission earned is extremely small in comparison to the good will of a client for a job well done.
Q. Would I have a better chance of finding my home if I use several Realtors?
A. No. In fact the opposite is true. Every Realtor has access to the same base of homes. When you work with more than one Realtor, the amount of time any one Realtor would be willing to devote to meeting your needs would be small.
Q. Why do I need to sign an agreement?
A. Connecticut Law requires Buyers to sign a Buyer Representation Agreement to see homes not listed by that Realtor’s firm. If the Realtor you are with does not explain this to you or ask you to sign a representation agreement, you should be worried.
Q. If I sign a Buyer Representation Agreement, how long should I sign for?
A. In all likelihood, the Realtor you contact will be willing to sign a Buyer Representation Agreement for a day or a short time such as a week. This way both of you can decide if you are right for each other. At the end of this short period, you should decide to sign an agreement for several months or move on to someone you feel more comfortable with.
Q. What happens if I sign two Buyer Representation Agreements?
A. When you first meet a Realtor, they should ask if you have signed a valid Buyer Representation Agreement with someone else and if it is still in force. If you have, it is unethical for them to work with you until you have cancelled that agreement. In the unlikely event that you end up signing two representation agreements, you should tell both Realtors and ask to cancel one of them. If you end up buying a home, both could ask for a commission. It is unlikely you would end up having to pay, but why run up legal bills.
Q. Do I need a Buyer Agent to look at homes for sale by owner?
A. No, but you should. It is amazing how often Buyers think they are getting a deal, only to discover when they want to sell that they overpaid. Your Buyer Agent will ask the owner to pay their commission and almost universally owners agree to do so.
Q. What is Dual Representation, Dual Agency and Designated Agency?
A. If one or more Realtors in a firm have signed an agency agreement with a Seller (Listing agreement) and an agency agreement with a Buyer (Buyer Representation Agreement) and if that Buyer wishes to negotiate for the purchase of that Seller’s property, then the firm is in the position of representing both parties. This is called Dual Representation. Dual Representation can take the form of either Dual Agency or Designated Agency.
Under Dual Agency, usually one Realtor represents both the Buyer and the Seller. If that Realtor is trusted by both parties, this can often work out to both parties benefit. Both the Buyer and the Seller must sign a Dual Agency consent agreement.
Under Designated Agency, one Realtor Represents the buyer and another Realtor in that same firm represents the Buyer. For firms which have the required safeguards, this option allows each Realtor to completely represent the interests of their client. Both the Buyer and the Seller must sign a Designated Agency consent agreement.
Q. Why wouldn’t every buyer want a Buyer’s Agent working for them?
A. We have no idea.
Can You Show me all the homes in Greenwich that are for sale?

Why do I need to sign an agreement before I can see a home?
Connecticut's Agency Law states that a Buyer wanting representation must sign a buyer representation agreement & be given a copy. This is a contract.
The terms of the buyer representation agreement are negotiable.
An agent of a real estate brokerage firm cannot show a buyer another firm's listing(s) without a written signed buyer representation agreement.

Why shouldn’t we put it on for a short time at a high price and see if we can get it?
Timing is extremely important in the real estate market. A property attracts the most interest from the real estate community and from "Educated" buyers during the first three weeks it is listed. If you price it high even for a couple of weeks, you will be missing most of this market. Ask for our booklet on Intelligent Pricing.
What is the greatest danger of overpricing
The house sits and doesn’t sell. Then it starts to be considered shopworn, you get only lowball offers and you end up taking a lower price than you might have if you priced it correctly to begin with.
If my house sells in the first month, doesn’t this mean we underpriced it?
No, this shows it was priced perfectly. If it were underpriced, you would have multiple offers in the first several weeks, possibly leading to an above market sale.
If I list my home at or below the market, won’t buyers think there is something wrong with it?
No, quite the contrary. Other Realtors will know it is priced realistically and they will tell their clients. Experienced buyers will also know it is well priced. Their questions will not be what is wrong, but what do I need to offer to be sure to get it before multiple offers come in and it goes to sealed bids.
Why can’t I just compare the houses that have sold to mine and determine its listing price?
When looking at recent sales, the house style, location, move-in-readiness, curb appeal and decoration play a major part. Comparing statistics between two houses only tells part of the story.
Then shouldn’t I just compare my house to ones on the market?
Until you have seen and toured them it is hard to tell which are priced correctly and which are over or under priced. This is the job of the active, full time Realtor. Every Tuesday and Thursday, they tour the new open houses.
How long should it take to sell my house?
The average number of months that a house remains on the market is about the same every year for overpriced homes. The chart below compares, for the year 2003, the average number of months a property was on the market against the percent the original asking price was above the eventual sales price. This chart shows that no matter how hot the market, if you price a property significantly above its market value, it will take a long time to sell, and often at a price substantially below what it would have sold for if priced accurately.

What do the number of showings and offers received tell me about my price?
If, during the first month, you are getting drive-bys but people are not actually showing the house, it means that the Realtors think the price is unrealistically high and are showing Buyers other properties where they can get more for their money. You are approximately 12+% above the market. If, after the first few weeks, you are getting only a few showings, it means Buyers are finding nicer homes for the money. You are approximately 6-12% above the market. If you are getting a reasonable number of showings, but no offers, it means you are close but still not in the running. You are approximately 4-6% above the market. If you are getting second showings but buyers are buying something else or giving you only very low offers, you are still 2-4% above the market. Ask your Realtor how many houses in your price range have sold. If your house is priced correctly, according to the National Association of Realtors, you should be receiving an offer for about every 10 showings. After the initial 4 weeks on the market, a correctly priced house in a normal market should be receiving 1-2 showings a week. During the initial excitement period, you should be receiving 8-12 showings a week.
Does it really matter to the Realtor if my house sells for the right price? After all, their commission is not dramatically affected if my house sells for less than it is worth.
It is true that the commission change is not great, but this misses the point. A Realtor’s business comes from happy customers and their referrals. No one can stay in business if they do not have Clients who feel that they always had their best interests at heart and worked hard to get them the best price possible.
Shouldn’t I leave room for bargaining?
Yes, some buyers always insist on trying to get a house below the listing price. They take great pride in appearing to get a bargain. However, this is not the buyer you really want. After bargaining down the price, they will usually continue to try to get more reductions based on their inspection reports. The buyers you want have seen enough homes in the market to know value when they see it. They will be happy to pay asking price or even above. Their agent, also knows value, and will counsel them to make a good offer.
If I still want to price my house above what the Realtor suggests, will they really try to market it?
If we agree to accept a listing at a price higher than the CMA suggests, we are also agreeing to market it aggressively. We will not compromise our reputation for superior marketing and client service. It is likely that real estate salespeople suggesting an inflated price may also be the ones who cannot be trusted to market it. They may be in the business of "buying listings" by suggesting an unrealistic price. They like the prestige of having a lot of listings and they count on the homeowner eventually reducing the price to a level where it will sell. They do the minimum and wait for the house price to come down.
Check to see if your Greenwich Contractor is Registered in Connecticut
Home Improvement Contractors must be registered in Connecticut with the Department of Consumer protection. If your contractor is not registered they will not be able to get a building permit. It is always advisable to get a building permit, not only will the town inspection give you some assurance that the job was done correctly, but the Certificate of Occupancy (CO) will be necessary when you try to sell your home.

Location
The Town of Greenwich was founded in 1640 and named for Greenwich, England. It encompasses 50.6 square miles and has 32 miles of shoreline on Long Island Sound. Situated 28 miles from Times Square, Greenwich is the first Connecticut town along the Boston Post Road (US1), the Merritt Parkway and the New England Thruway (I-95).
Greenwich offers a harmonious blending of bays, coves, rivers, lakes, hills, valleys and woods. The countryside gently rises back from its coastline in a series of ridges to 600 feet above sea level seven miles to the north. The town is roughly five miles wide, east to west; and ten miles deep, north to south.
Commuting and Transportation
Greenwich is ideally located outside of New York City. Express service on the Metro North Railway averages 45 minutes to Grand Central Station at 42nd Street. There are over 90 trains in both directions each day.
There are several limousine services providing easy transportation directly to New York/New Jersey airports. JFK, LaGuardia, & Newark. The adjacent Westchester County Airport is widely used by local executives and firms.
The Merritt Parkway, New England Thruway and Putnam Avenue (Post Road) are major highways traversing Greenwich in an east-west direction, while North Street, Lake Avenue, Round Hill Road and Stanwich Road are the major north-south thoroughfares. Via these roads, the major shopping areas of Westchester County and Stamford with their branches of major New York department stores are only a short drive. Also available is Public Transportation, such as bus service making stops on major streets, private limousine and chauffering services, as well as Greenwich Taxi service.
Hospitals
The modern, excellently equipped Greenwich Hospital has a capacity of 296 beds and 21 bassinets. The department of Emergency Medicine, open round-the-clock and staffed by full time physicians, administers care to 26,000 patients each year. An additional 12,000 patient visits are recorded yearly in the Outpatient Department, which has clinics representing all of the subspecialties in medicine. The hospital is a voluntary non-profit association and one of the most modern of its kind in the nation.
Chronic cases of older residents are cared for by the town-owned Nathaniel Witherell Hospital. Parsonage Cottage, also a Town facility, is for the well elderly.
Government and Taxes
The first town in the state to adopt a Representative Town Meeting form of government, Greenwich is divided into 12 districts with elected representatives in proportion to the number of registered voters in each district. The administrative functions are performed by a three man board of Selectmen and the heads of the town departments. A board of estimate and taxation serves as Greenwich's comptroller and its recommendations may be decreased but not increased by the Representative Town Meeting. Greenwich enjoys one of the lowest tax rates in the area. This may be ascribed to a long history of sound fiscal management, achieved without stinting on services. Greenwich folows a pay-as-you-go policy on spending, thus keeping the town relatively free of debt.

BUYING A HOME:
1. Making the Decision to Buy:
The decision to purchase a home is often driven by the need for more space, the need to move to a new location or simply the desire to change one's life style. If you are unfamiliar with the area to which you are moving, the REALTOR you choose must make an effort to introduce you to the characteristics of the community and help you decide if this is a good match for your needs. Within any community there are variations by neighborhood, and these should become clear to you as you are shown properties in the community. By giving your REALTOR feedback, you can make the search process more efficient. If your REALTOR learns that you do not want to buy in a particular neighborhood, he or she will not show you properties there and will concentrate instead on those areas which interest you.
2. Selection of a REALTOR:
The selection of a REALTOR in a community such as Greenwich is made easier by the presence of the Greenwich Multiple Listing Service. Almost every real estate agent in the community is a member of the Greenwich MLS, which gives each REALTOR access to every property listed by every office in the membership. Therefore, it is not necessary to seek the services of more than one REALTOR
In your selection of a REALTOR, you should look for someone with whom you are compatible. When you initially meet with a REALTOR, whether this is someone to whom you have been referred or someone you have randomly chosen, you will be asked to sign a buyer authorization form. Required by state law in order for the REALTOR to show you properties, provide you with information, and negotiate on your behalf, this agreement will state the time frame during which the agreement is in effect, the kind of property it covers, and the area of Connecticut in which it is effective. If you are uncomfortable making a commitment to a REALTOR, ask that the time frame be limited to a day, a week, a month or any time frame which you feel you need to determine whether you would like to work with this person. When you ascertain that the relationship is compatible, you can sign an extension of the time frame.
Since every REALTOR has access to the same properties through the Greenwich Multiple Listing Service, there is no need to use the services of more than one REALTOR concurrently. In fact, doing so can cause confusion to you and your REALTOR. Be sure that you have specifically described what you are looking for in a property and ask your REALTOR to introduce you to properties which most closely meet your criteria. Give feedback on properties that you are shown, so that your REALTOR can continue to refine the picture of what you need. If your criteria changes, communicate this to your REALTOR. For example, if you decide that a particular style of house does not fit your needs, let your REALTOR know so that houses of that style are no longer shown to you.
It is a REALTOR's responsibility to inform you of any material facts about a property which he or she knows. These facts would be things such a condition of roof, presence of wetlands on a property, a known change to a road which will impact the property, etc. It does not include information about the seller's reason for selling, who the neighbors are, etc. Your REALTOR may not know everything about the property's condition; that is why you will have a building inspection done before signing the contract to purchase.
When you have developed interest in a particular property, your REALTOR will be able to provide information about comparable sales in the area to help you determine value. Your REALTOR can arrange for you to visit the local schools, obtain information about programs available in the area and help you select the appropriate property.
3. Mortgage Pre-Approval:
You will contact a mortgage company or banking institution to understand what purchase price might be correct for you. Further understanding of your financial situation will allow the lender to issue you a "Pre-Approval" letter which stipulates that you have been approved for a mortgage up to a specific dollar value. This is a valuable asset for you during the negotiation process. If you are not familiar with the names of lenders in Greenwich, your REALTOR will be able to provide you with that information.
4. Finding the Right Property:
The search for your new home is truly a joint effort between you and your REALTOR. Be as open with your REALTOR as possible about your likes and dislikes. It is very important to tell your REALTOR what you like about each house you visit so he/she will begin to understand what you are looking for in the home you wish to buy. Between your input and your REALTOR's professional skills, the search will narrow until you ultimately find the "right" property for you.
5. Making an Offer to Purchase:
Once you have focused on one or two properties, your REALTOR will be able to provide you with market data on recently sold properties. This information will help both you and your REALTOR formulate your offer. Working with your REALTOR, you will be able to determine where you would initially like to start with your offer price. You should then develop a set of strategies, each dependent upon how the seller responds to your offer, so you do not end up "reacting" to any counter offer made by the seller.

This complete offer is then presented by your REALTOR to the Listing Agent for the property. The seller may respond in any one of the following manners:
Once a verbal agreement has been reached, a written "Offer to Purchase" is prepared by your REALTOR outlining the terms agreed to by you and the seller. This document is then transmitted to the Listing Broker and the attorneys of record.
6. Finalizing your Financing:
After an offer has been accepted by the seller the lending institution you have chosen will require an appraisal on the property to be mortgaged. The institution will send one or sometimes two appraisers to do a thorough inspection of the property to determine whether the property will qualify for the desired mortgage. Once the institution agrees to finance a particular property, they will issue a commitment letter whereby they agree to provide a certain dollar mortgage at a specific rate for a specific time and the buyer is assured the financing is in place.
7. Utilities and other details:
Your REALTOR will remind you about two weeks prior to closing that the appropriate utilities and services need to be notified in order to transfer the accounts to your name. These include, electric, gas, oil, propane, telephone and refuse. They may also include pool services, yard maintenance and more. During the same period the seller will be contacting the same providers to discontinue the same services. This transition needs to go smoothly to protect you from having to pay a "connection or hook up fee" because the service was completely terminated. Your REALTOR can help you with this, but the companies now require the new homeowner to initiate requests for service.
8. The Contract:
The seller will instruct their attorney to draw the Contract of Sale to include the terms agreed upon. Your agent will ensure that, at the same time, your attorney receives the necessary information so that he/she can begin their work and be prepared to receive and review the contract. Your attorney will review the contract from your perspective and insure that your interests are protected (such as including stipulations for delays, searching of Title, type of Title to be conveyed, cleanliness of the premises at the time of closing, etc.) The timing of this, dependent upon the complexity of the terms, should all take between five to ten days from accepted offer to signed contracts. You will normally be expected to submit an escrow check in the amount of 10% of the total purchase price (made out to the seller's attorney) with the signed contract.
9. Closing Day:
On the day of your closing, you and your REALTOR need to perform one last walk through of the premises. Each year for the last 18-years the magazine has published a chart of the value of different remodeling projects. They are a good indication. Each house and neighborhood is different. You should ask one of our Realtors if your specific remodeling project will "pay off" at resale.
